Terms of Use Agreement
This Terms of Use Agreement (these “Terms of Use”) is a binding legal contract between you (“You” or “Your,” whether an individual or a legal entity) and Inclusive Horizons. These Terms of Use govern Your access to and use of the websites, applications, in-app services, media, cloud-based platforms, and any other services provided by Inclusive Horizons, including without limitation all software, databases, materials, content, tools, products, and features made available through them (collectively, the “Services”).
By downloading, accessing, or using any part of the Services, You agree to be bound by these Terms of Use. If You do not agree, Inclusive Horizons does not grant You any right to use the Services, and You must immediately discontinue access.
1. Eligibility
By using our Services, You represent and warrant that You are at least 18 years of age, or that You are under 18 and have the consent of a parent or legal guardian.
2. Use of Services
You agree to use the Services only for lawful purposes and in a manner consistent with the nonprofit mission of Inclusive Horizons.
You shall not use the Services in any way that could damage, disable, overburden, or impair their function.
You shall not engage in activities that infringe upon the intellectual property, privacy, or legal rights of others.
3. Accounts & Registration
Registration by You as an authorized user for access to certain areas of the Services may require both a user name and a password (collectively, “Authorized User Credentials”). You may also be required to provide certain registration information, all of which must be accurate, complete, and kept up to date.
You may not share, transfer, or give Your Authorized User Credentials to anyone else.
You are solely responsible for maintaining the confidentiality of Your Authorized User Credentials and for all activity conducted under Your account.
You agree not to use another person’s Authorized User Credentials.
You agree not to select Authorized User Credentials that:
- Intend to impersonate another person;
- Belong to another person without authorization;
- Violate or infringe upon another person’s intellectual property rights; or
- Inclusive Horizons, in its sole discretion, deems inappropriate, offensive, or discriminatory on the basis of race, color, sex, gender identity or expression, sexual orientation, language, religion, political or other opinion, national or social origin, property, birth, disability, or any other protected status.
You acknowledge and agree that You shall have no ownership or property interest in Your account or Authorized User Credentials, and all rights in and to accounts and user names remain the exclusive property of Inclusive Horizons.
Failure to comply with this Section constitutes a material breach of these Terms of Use and may result in the immediate suspension or termination of Your account and Authorized User Credentials.
4. Intellectual Property
All content available through the Services—including but not limited to text, graphics, logos, digital resources, and software—is the exclusive property of Inclusive Horizons or its licensors, protected under applicable intellectual property laws.
You may use such content only for personal, non-commercial purposes in support of Inclusive Horizons’ mission.
Reproduction, modification, distribution, or commercial exploitation of any content without prior written permission is strictly prohibited.
5. Grant of License
Grant of License. Inclusive Horizons grants You a personal, revocable, nontransferable, nonexclusive license to use the Services for personal, non-commercial purposes, conditioned upon Your continued compliance with these Terms of Use.
Limitations on License. The license granted to You in these Terms of Use is subject to the following restrictions:
- Limitations on Copying and Distribution. You may download or copy items made available for download through the Services for personal, non-commercial use only, provided that You maintain and display all copyright, trademark, and other proprietary notices contained in the materials.
- Limitations on Use. You may use and access the Services solely for lawful, personal, and non-commercial purposes. Except as expressly permitted, You may not use, copy, store, reproduce, transmit, distribute, display, modify, alter, license, sublicense, or commercially exploit the Services or any content, data, or materials provided through the Services. You may not assign, sublicense, rent, timeshare, loan, lease, or otherwise transfer the Services or permit any third party to use them.
Prohibited activities include, but are not limited to:
- Using any automated device, program, script, algorithm, or methodology (including “robots,” “spiders,” or “scrapers”) to access, copy, or monitor the Services in a manner not intentionally made available by Inclusive Horizons.
- Attempting to gain unauthorized access to any portion of the Services, including the accounts of other users, systems, servers, or networks connected to the Services, by hacking, password mining, or other unlawful methods.
- Probing, scanning, or testing the vulnerability of the Services or any network connected thereto, or breaching security measures.
- Reverse look-up, tracing, or attempting to trace information about another user of the Services.
- Taking any action that imposes an unreasonable or disproportionately large load on the Services’ infrastructure.
- Using any device, software, or routine to interfere with the proper functioning of the Services or with any person’s use of the Services.
- Collecting or harvesting email addresses or contact information through the Services.
- Marketing, co-branding, private labeling, reselling, or otherwise permitting third parties to access or use the Services without prior written permission from Inclusive Horizons.
- Reproducing or embedding intact portions of the Services into another website, app, or service.
- Using the Services in an unlawful manner or in any way that could damage, disparage, or negatively impact Inclusive Horizons.
- Non-Solicitation. You may not post or transmit through the Services any material containing advertising, marketing, or solicitation for products or services.
- Limitations on Reverse Engineering and Modification. You may not reverse engineer, decompile, disassemble, modify, or create derivative works of the Services or of any materials accessed through the Services.
- Proprietary Notices. You may not remove, obscure, or alter any copyright, trademark, or other proprietary rights notices appearing in the Services or on any materials accessed through the Services.
- Compliance with Applicable Law. You are solely responsible for ensuring that Your use of the Services complies with all applicable local, state, federal, and international laws, rules, and regulations.

The Services may contain links to third-party websites or resources. Inclusive Horizons does not control and is not responsible for the content, accuracy, or practices of any third-party sites. The inclusion of links does not imply endorsement by Inclusive Horizons.
7. Donations
Donations made through the Services are voluntary and generally non-refundable, except as required by law.
All donations are used to further the mission of Inclusive Horizons in compliance with nonprofit regulations.
8. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how Inclusive Horizons collects, uses, and safeguards Your information.
9. Disclaimers
The Services are provided “as is” and “as available,” without any warranties of any kind, whether express or implied.
Inclusive Horizons does not guarantee that the Services will be uninterrupted, secure, or error-free.
Information provided through the Services is for educational and informational purposes only and should not be considered legal, medical, or professional advice.
10. Limitation of Liability
To the fullest extent permitted by law, Inclusive Horizons and its officers, employees, contractors, and volunteers shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to Your use of the Services.
11. Indemnification
You agree to indemnify, defend, and hold harmless Inclusive Horizons, its officers, employees, volunteers, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) resulting from Your use of the Services, violation of these Terms, or infringement of any rights of third parties.
12. Termination
Inclusive Horizons reserves the right, at its sole discretion, to suspend or terminate Your access to the Services at any time, with or without notice, for conduct that violates these Terms or is otherwise deemed harmful to the organization.
13. Governing Law, Venue & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict of law principles.
Any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Michigan. You consent to the jurisdiction of such courts.
Mediation & Arbitration:
Before pursuing litigation, both parties agree to attempt to resolve disputes in good faith through mediation.
If mediation fails, disputes shall be submitted to binding arbitration in Michigan under the rules of the American Arbitration Association (AAA) or another mutually agreed arbitration body.
Arbitration will be conducted by a single arbitrator, whose decision will be final and enforceable in any court of competent jurisdiction.
Each party will bear its own costs unless otherwise required by law or determined by the arbitrator.
This arbitration clause does not apply to claims that must legally be filed in a court (e.g., nonprofit compliance or certain statutory claims).
14. Changes to Terms
Inclusive Horizons reserves the right to modify or update these Terms of Use at any time. Changes become effective upon posting to the Services. It is Your responsibility to review the Terms periodically. Continued use of the Services constitutes acceptance of any modifications.
